broke (5) ribs on the job and fired 40 days later for being off to long
I was at work at clars auction gallery in Oakland California I was a truck driver that went to homes and businesses to pick up articles to be auctioned off under consignment on December 4th of 2007 I was loading my truck at our building with items that were going to be donated when my foot slipped off the lift-gate and sent me falling from about 31/2 feet off the ground and I landed on my side over the back of a dinning chair just like if you were to throw a towel over the back of a chair and was taken to emergency by ambulance.On 01/18/2008 I received an email from my employer letting me know that as of that date my job was being terminated due to the length of time I had been gone and they needed to hire someone else to take care of their heavy work load. I guess there is a time limit on how fast your broken ribs are supposed to heel and I am still on Workman's comp to this day and my ribs are doing better though are not completely heeled yet and the doctor has not yet released me to return working.
And much to my surprise after talking to a few lawyers this is legal for them to do if you can believe that. the workers have no rights what so ever. So my advice to everyone is if you are not a fast heeler then make sure that your on the job injury's are minor or bad enough to leave you disabled.
