fired before I was hired?

I had a great interview with a major firm. My starting pay was set. they had a firm do a background check on who they said was me. Only the middle name was not mine. Any way I was told i was not selected because of a problem with my background check. when i called the firm that does their background checks to point out the mistake I was told sorry they would call the firm and correct the mistake. only to late
the firm chose not to hire me because they got bad information on someone else who they thought was me.That was the best paying job i never had?

    Wow that sucks for you but it happens a lot. You'll just have to pick up and go look for another job.

    Don't they usually use your SSN for that? Who does a background check with a name without verifying the SSN? They probably just googled your first and last and ran with what they found, even though it wasn't you. Do you really want to work for a company that is that stupid?

    I used to own a screening company, in all 50 states it is illegal not to hire you based on your background check without giving you the opportunity to dispute the results, and if the dispute clears you, it is illegal for the employer to retract the offer, even if they hired someone else. Basically, this stuff is regulated by the FCRA, very similar to credit reports.

    1 more thing, the background screening company can be liable if they were careless or negligent, otherwise they have protections under the FCRA as well.
