Was I fired or did I Quit?

First of all, my boss was the meanest man I have ever met. Trust me I was always picked on during school and that did not compare to this guy. He was going through a divorce at the time I got hired. As you might guess, he was even meaner. (to put it politely) On one day he called me incompetent, on the next day he said I was doing the best work ever. On another week, he understood we were getting some poster boards a week later. He said I was "making his life harder" I was not considerate of him.

Then another time, he complimented me by saying "WOW your English is pretty good." This is where I have to explain I was born in Mexico. However, I had gone to elementary, junior high, high school, college, and law school in the United States. Then, he would have me file and make copies for him, no other attorney in the firm had to such things. Trust me there were plenty of secretarties. There was another instant when he called three of us into his office. He threw a bunch of paper at one guy, he wrote "pure s@#$%" in big bold letters accross one of my papers. Then he proceeded to yell at another guy for "giving me" an assignment, that he had assigned to me himself.

What really drove me nuts was one day he got mad, because I did not do the filing correctly. He came into my office, with another attorney. He said he was tooo frustrated with me. He could not deal with me anymore. That and I quote, "his antidepresants could only do so much." He asked me to never report to him again. I felt like the worse attorney. I felt I was worthless as a professional

The last straw for me was this week. He called me and told me I was a secretary not an attorney. He said my work frustrated him so much. He started to make fun of me and my ideas. So, when we hung up I went to the office manager's office and put in my resignation. I got another call before quitting time from him. He started to make fun of me again. At that point,I told him I was leaving on friday to finish my work. He said, "no, you are leaving high and dry, just like my mother and my wife..goodbye."

The next thing I see the office manager coming to my office. He called her and told her to go into my office and tell me to get out.. that I was fired. So, did I quit or was I fired?

He called again after my meeting with the office manager, he starts making fun of me on the phone again. However, he says dont worry Im doing this to train you..dont go looking for other jobs. Thats when I just said dont worry, Im leaving. I put in my resignation, Im leaving on Friday. He said " you are leaving high and dry." Then I said, "no, im not im going to finish my work and then im leaving." He said

    I think that counts as quitting. This man sounds HORRIBLE. He doesn't deserve a job for treating people that way.

    You should make sure that the company knows, as you know, that your resignation was put in first.

    You quit and during your notice period were told not to return. If they paid you until the last day of your notice period you quit. If they paid you only until the date they told you to leave they terminated you early. In the latter case you would propably be eligible for unemployment.

    I would say in future interviews that you resigned from the firm. This is true. You would not be lying. All the firm you left can say legally to any future employer is that you would not be eligilbe for rehire there. They can not legally divulge any more information than that if my understanding of employment law is correct. That's the way it is in Texas and don't know if it varies state by state or not.

    it just occurred to me that he made fun of your english. you are hispanic and that is against the law. Discrimination because of ethnic origin. If you wanted you could sue over this.
